terms of service
These terms apply when you book a Fix Call or hire us for work. They are written to be read, not to be survived. If something here is unclear, ask before you book.
1.who these terms are with
Your agreement is with 15959217 Canada inc., a corporation incorporated under the Canada Business Corporations Act, carrying on business as HydroDevs and HydroDevs.com (“we”, “us”). Our operations are based in Quebec. “You” means the person or business booking a call or hiring us.
Booking a Fix Call means you accept these terms. Each job is separate: there is no retainer, no minimum commitment, and no automatic renewal.
2.the $49 fix call
The Fix Call is a 30-minute call, paid at the time you book. On it you show us the problem or the feature you want, and we work out what it takes.
- If you hire us, the $49 is credited in full against your first invoice
- If we decline the job, the $49 is refunded in full
- If you simply decide not to proceed, the $49 is not refunded. You received the call and the assessment
- If you do not attend and did not reschedule at least 12 hours ahead, the $49 is not refunded
You may reschedule once at no charge.
3.quotes and scope
Within 24 hours of the call we email one fixed price, a written scope, and a delivery timeline. Standard fixes start at $495 USD. The quote is valid for 14 days.
Work begins only after you approve the quote in writing. Email is writing.
The scope is the boundary. Anything outside it is a new quote, not an adjustment, and we will tell you before doing it rather than after. If, once we are inside the code, the problem turns out to be materially different from what was diagnosed, we will stop and requote rather than absorb it silently or bill you more than you agreed.
4.delivery and the 48-hour guarantee
The guarantee applies only where the quote explicitly states a 48-hour delivery. Where it does, and we miss that deadline, you do not pay for that fix.
It does not apply to feature builds or larger work, which carry their own quoted timeline. It also does not apply where the delay is caused by something outside our control, including delayed access or credentials, delayed answers from you, third-party app or platform outages, or a Shopify-side restriction.
The clock starts when you approve the quote and we have working access, whichever is later.
5.what we need from you
- Timely access to the store, with a staff account at the permission level the job needs
- A current backup, or a duplicated theme we can work against
- Answers within a reasonable time when we ask a blocking question
- Confirmation that you are entitled to authorise work on the store
We work on a duplicated theme wherever the job allows, and tell you before anything goes live.
6.payment
Prices are in US dollars and exclude any applicable taxes, which are added where required. Invoices are due on receipt unless the quote says otherwise. Work is delivered on payment; larger builds may be split into instalments set out in the quote.
Late amounts carry interest at 1.5% per month (19.56% per year) from the due date.
7.who owns the work
Once you have paid in full, the code we wrote specifically for you is yours, and we assign the intellectual property rights in it to you.
We keep ownership of general methods, techniques, and any pre-existing or reusable components we brought to the job, and we grant you a perpetual, non-exclusive licence to use those as part of your store. Nothing stops us doing similar work for other clients.
Third-party code, apps, and licences remain governed by their own terms.
8.confidentiality
We keep your business information, store data, and credentials confidential, and share them only with contractors working on your job, who are bound to the same obligation. This survives the end of the engagement.
We will not name you publicly or describe your store as a case study without your written permission. Personal information is handled as described in our Privacy Policy.
9.what we do not promise
We deliver the work described in the quote, done competently. We do not promise a particular commercial outcome: not a revenue figure, not a conversion rate, not a search ranking, not a specific Core Web Vitals score. Too much of that depends on your traffic, your products, your pricing, and platforms we do not control.
Where a fix is measurable, we show you the before-and-after. That is evidence of the work, not a guarantee of a result.
Except as stated in these terms, our services are provided as-is, and we exclude all other warranties to the fullest extent the law allows.
10.limit of liability
Our total liability for any claim connected to a job is limited to the amount you paid us for that job.
We are not liable for indirect or consequential loss, including lost profit, lost sales, lost data, or business interruption, even if we were told it was possible.
Nothing here limits liability that cannot be limited by law, including liability for gross or intentional fault. If you are a consumer within the meaning of Quebec's Consumer Protection Act, that Act's mandatory protections apply regardless of anything in these terms.
11.ending an engagement
Either of us may end an engagement in writing at any time. If you end it after work has started, you pay for the work completed to that point. If we end it for a reason that is not your fault, we refund anything you have paid for work not delivered.
We may decline or stop work that we consider unlawful, unsafe for your store, or outside our competence, and will say so plainly.
12.governing law and language
These terms are governed by the laws of the Province of Quebec and the federal laws of Canada that apply there. Any dispute goes to the courts of the judicial district of Montréal, Quebec.
If a court finds any part of these terms unenforceable, the rest stays in force.
Language. The parties have expressly requested that these terms and all related documents be drawn up in English. Les parties ont expressément demandé que ces conditions et tous les documents qui s'y rattachent soient rédigés en anglais.
